i. Appeal for Entry Permit Application


An Entry Permit is a permit that allows a foreign national to enter and reside in Malaysia beyond the validity period of their current pass. The Entry Permit is issued under Section 10 of the Immigration Act 1959/63. Approval of this Entry Permit qualifies the holder to apply for Permanent Resident status (MyPR) in Malaysia.


All Entry Permit applications must be submitted to the Immigration Department of Malaysia. If the applicant is dissatisfied with the decision,an appeal petition must be submitted by the applicant personally to the Minister of Home Affairs within 30 days from the date of the rejection letter.


An appeal for an Entry Permit must be submitted with the following documents:

•    Appeal letter prepared personally by the applicant
•    Rejection letter from the Immigration Department of Malaysia
•    Marriage certificate (for Muslims)
•    Marriage certificate (for non-Muslims)
•    Copy of applicant’s passport (since entering Malaysia)
•    Copies of identity card, citizenship certificate, and birth certificate for the sponsor, applicant (if any), and children
•    Copy of divorce certificate and death certificate (if applicable)
•    Copy of professional certificate and employer’s support letter (if available)
•    Letter of Recognition of Expertise from relevant agencies (if available)
•    Companies Commission of Malaysia (SSM) statement (if available)
•    Declaration of renunciation of foreign citizenship (if applicable)
•    Copies of academic certificates (if available)
•    Resume/Curriculum Vitae (if available)
•    Copy of employment offer letter (if available)
•    Copy of property ownership documents (if available)
•    Copy of fixed deposit record (if available)
•    Copy of the company’s Employees Provident Fund (EPF) statement (if available)


ii. Appeal Against Entry Permit Cancellation


According to Section 14(5) of the Immigration Act 1959/63, an appeal against the cancellation of an Entry Permit may be submitted to the Minister of Home Affairs within the stipulated time after the cancellation notice has been issued.


For the purpose of appeal, the applicant must submit the following documents:

1.    An official appeal letter regarding the cancellation of the Entry Permit, complete with justification and strong reasons why the permit should be retained or reinstated;
2.   A copy of the cancellation notice issued by the Immigration Department of Malaysia;
3.    Additional supporting documents, if relevant, such as:
o    Copy of Marriage Certificate (Nikah/Marriage);
o    Copy of Birth Certificate (e.g., to prove family relationship);
o    Any other relevant documents that may support your appeal.


Note: Ensure that all submitted documents are clear, complete, and certified (if required). Failure to provide sufficient documentation may result in delays or rejection of the appeal.

The applicant will be notified of the outcome of the appeal through an official letter once all necessary actions and processes have been completed. Therefore, the applicant is reminded to ensure that their current Immigration Pass remains valid and not expired. 1. Application for Approval from the Ministry of Home Affairs (KDN) for the Admission of International Students


1. Admission of International Students by Educational Institutions

The Ministry of Home Affairs (KDN) supports the government's aspiration and effort to make Malaysia a regional center of educational excellence.

Act and Regulation

Based on Regulation 13 (5) of the Immigration Regulations 1963, it is stipulated that:

a. Any educational institution that intends to recruit international students must obtain approval from the Minister of Home Affairs.
b. Whereas for educational institutions in Sabah and Sarawak, approval must be obtained from their respective State Governments.

All institutions that intend to require international students must obtain support from the relevant regulatory agency and subsequently obtain approval from the Ministry of Home Affairs such as Private Educational Institutions (IPTS), Polytechnics, Language Centers, Skills Centers, Training Centers, international schools, and accredited centers in Malaysia.

Any educational institution that intends to recruit international students for the first time (new application) or renewal must obtain certification from the regulatory agency before being submitted to KDN for consideration.

KDN will process the application for the admission of international students based on the following criteria:

i    Applications that are complete and meet all criteria are to be submitted to the Ministry of Home Affairs through their respective regulatory agencies.
ii    Complete applications from regulatory agencies must include the following details:

a.    Support letter / certification from the regulatory agency;
b.    Latest Institutional Profile;
c.    Copy of Institution Registration Certificate;
d.    Inspection Report from the Regulatory Agency;
e.    Copy of previous Ministry of Home Affairs approval letter;
f.    Statistics of international students who completed studies in the previous year (if any);
g.    Official explanation letter if there was no intake of Foreign Students (Previous Year); and
h.    Attachments / relevant institutional documents (e.g., Company Commission of Malaysia Registration Certificate, Form 44, 24, 9).

iii    If the application is approved, the institution must comply with all Immigration rules and procedures as follows:

a.    Ensure that the management of international student records is always updated. Records must include residence status, start and end dates of study;
b.    Ensure all international students have valid and active student passes;
c.    Apply for shortening of student passes for students who have completed studies and wish to return to their home countries or continue studies at other institutions;
d.    Obtain exit check memos for students who wish to return to their home countries;
e.    Take action according to procedures in cases of students missing / untraceable, namely;

•    Make a police report
•    Submit a report to inform the relevant embassy
•    Submit a report to the Immigration Department of Malaysia for the purpose of checking the movement status of the student

f.    If the conditions for the approval of international student admission as stated above are not complied with, the Ministry of Home Affairs reserves the right not to consider the institution's application or to revoke the approval already granted.

Approval for the admission of international students by Educational Institutions can be revoked at any time by KDN if the Educational Institution is found to have violated the Immigration Act 1959/63 & Immigration Regulations 1963 and other stipulated conditions. After obtaining KDN's approval to admit international students, Educational Institutions can apply for Student Passes at the Immigration Department of Malaysia.

2. Second Appeal Application for Expatriate Post after Rejection by the Immigration Department of Malaysia

Employers or companies in Malaysia are allowed to employ expatriates or foreign professionals to fill appropriate positions that cannot be filled by local manpower.

Companies which applications have been rejected by the Expatriate Committee are given the option to appeal to the Director General of Immigration. However, if this appeal is also rejected, employers are allowed to submit a second appeal to the Ministry of Home Affairs.

The Immigration Affairs Division will process and submit a decision on the appeal application for expatriate posts within 14 working days after the complete application is received.

3. Application for Non-Citizen Government Officers Exceeding 10 Years of Service

Pekeliling Perkhidmatan Sumber Manusia – Kaedah Pelantikan Pegawai dalam Perkhidmatan Awam dan Urusan-Urusan Lain Berkaitan Pelantikan Versi 1.0 (2022) states that "the total period of contract appointment of non-citizen officers must not exceed 10 years including service under different employes. Any contract appointment exceeding this period must first obtain KDN approval."

Employers or IPTA must submit justification to appoint non-citizen contract officers exceeding 10 years and the succession plan to be implemented in the institution to the Immigration Affairs Division of KDN.

The Immigration Affairs Division will process this application within 14 working days after the complete application is received.

4. Application for Foreign Media

Foreign media companies operating in Malaysia are allowed to employ expatriates to fill appropriate positions.

Applications that have obtained support letters from the Ministry of Foreign Affairs or Malaysia Digital Economy Corporation (MDEC) must be submitted to the Immigration Affairs Division for approval before the Employment Pass is issued by the Immigration Department of Malaysia (JIM).

The Immigration Affairs Division will process foreign media applications within 14 working days after the complete application is received. The decision of the application will be informed to the applicant.
